This Consignment Agreement (ÂAgreementÂ) is made this ____ day of
______________, 2004, between __________ ___________________ of ______Chicago____________,
___IL (ÂClientÂ) and JimÂs Big Store (ÂSellerÂ).
(A) The Client will consign listed items over to Seller for the sole purpose
of listing and selling items on eBay. Client stipulates that they have
full ownership of the product and the right to sell it.
(B) Seller will charge the Client a Rate of Commission of 35% (ÂCommission
FeeÂ), with starting auction prices up to $9.99 and no reserve. This Commission Fee will be assessed on the ÂFinal Auction
Sold Price for each item(s). Seller will collect all payments for
Client. Seller will provide a report on the items sold during the term of
this Agreement along with payment for the net amount owed to Client within
seven (7) days after the termination of this Agreement. There
is a minimum commission fee of $9.00 per item whether the item is sold or
not. The commission charged per item covers all fees assessed by
third parties in the selling of the item. There is a $20.00 per
item fee for the use of reserve pricing or starting bids higher than
$9.99. This fee is non-refundable if the item doesn't sell.
These items will only be listed for one 7 day auction cycle. If the
item sells, the $20 will be deducted from the commission.
(C) The Seller will handle all shipping and will collect the shipping
fees as a normal course of business. The shipping fees do not change the
Final Auction Sold Price.
(D) Attached hereto as Exhibit ÂAÂ is an inventory of all items
Client has consigned to Seller.
(E) This Agreement will be for a period of thirty (30) days from the date
of execution shown above.
(F) If any item(s) of this Agreement are not committed to ÂSOLDÂ
status, such item(s) will be returned to the Client within seven (7) days
after the termination of this Agreement unless an Agreement Extension is
requested by the Client and a fee of Ten and no/100 Dollars ($10.00) per
item is received.
(G) Client may terminate this Agreement at any time by
notifying Seller in writing at the address below. If Client terminates this
Agreement, Client will be responsible for all eBay fees incurred by Seller
on ClientÂs behalf for unsold items. All unsold items will then be
delivered to Client within seven (7) days of termination.
(H) Seller may terminate this Agreement at any time by notifying Client
in writing. If Seller terminates this Agreement, Seller will provide Client
with a report detailing all Sold items along with payment for those items
within seven (7) days of termination. Seller will, at SellerÂs sole cost
and expense, return all Unsold items within seven (7) days of termination of
this Agreement.
